Prepare a will or trust along with powers of attorney for finances and healthcare.
Just having a few essential documents in place can give you peace of mind in case of unexpected life circumstances. They can also help avoid unnecessary court involvement.
- A Last Will and Testament distributes your estate according to your wishes upon It also addresses guardianship for minor children. Everyone should at least have a simple will. Naming someone to take care of your estate and stating where your assets should be distributed is important to provide for your family and protect the hard work you have done during your lifetime.
Some may also want to consider a revocable living trust. This is an optional document that is attractive to some who value privacy and want to avoid the probate system.
- A General Durable Power of Attorney names someone to care for your finances. Having this document in place can provide for a smooth transition in case you cannot participate in financial transactions or make financial decisions for yourself.
- A Health Care Power of Attorney names someone to make health care decisions for you if you cannot communicate in any way. It is important for your family and the medical community to know who to look to in this circumstance.
Be sure to include living will provisions. These state your preferences regarding end-of-life medical treatment. You can state whether or not you want heroic measures taken to prolong your life and also state your choices regarding the use of artificial nutrition and hydration. It is comforting for your family and doctors to know how you would like to be taken care of in your last days.
Depending on what state you live in, living will provisions may be included in a health care power of attorney document, or they may be in a separate document.
